摘要 | Though extraterritoriality in China has previously been studied by historians, the author reexamines the system from the rarely researched point of view of the Qing empire (1644-1911) and how earlier experiences and policies shaped the formation of the extraterritorial system and specifically the Mixed Court in Shanghai (1864). The precedents set by the Qing legal system concerning the different treatment of ethnic groups paved the way for the Qing empire to accept and accommodate foreign demands for extraterritoriality, revealed by comparing and noting the similarities between the Chinese version of the treaty texts with legal documents concerning Sino-Manchu relations. The Mixed Court in Shanghai is the most notable example of the continuity between traditional and treaty port institutions. |
